Supreme Court Strikes Down Section 2 of DOMA

The Supreme Court of the United States, in a 5-4 decision, held that Section 2 of the federal Defense of Marriage Act (“DOMA”) is unconstitutional.   The case has wide and far reaching implications for same sex couples in states where same sex marriage is recognized and paves the way for future challenges to bans in other states.    In the meantime, we will be analyzing the decision to determine how it affects couples in Ohio.  We hope it will allow same-sex couples to file joint Chapter 7 and 13 bankruptcy cases together but further research is necessary to gauge the full scope of today’s decision in Windsor v. United States.  Stay tuned.
